Some clients may not recognize the symptoms of a brain injury, which can lead to medical complications. It’s important to understand what a traumatic brain injury is and how they can occur.

A person is at risk for a traumatic brain injury whenever they are involved in an accident that has movement at high-speed, or a rapid change in speed, like automobile accidents, motorcycle accidents, bicycle accidents, fights, violent shaking or a fall.  Physical signs like scrapes or bleeding need not be present to have a significant brain injury.   Similarly, one does not need to pass out or lose consciousness to have a serious injury. It is critical that anyone involved in an accident where they hit their head sees a medical professional as soon as possible for a full evaluation.

According to the <a href="https://www.cdc.gov/traumatic-brain-injury/data-research/index.html#:~:text=There%20were%20approximately%20214%2C110%20TBI,TBI%2Drelated%20deaths%20per%20day." data-wpel-link="external" target="_blank" rel="noopener noreferrer">CDC</a>: “There were approximately 214,110 TBI-related hospitalizations in 2020 and 69,473 TBI-related deaths in 2021. This represents more than 586 TBI-related hospitalizations and 190 TBI-related deaths per day. These estimates do not include the TBIs that are only treated in the emergency department, primary care, urgent care, or those that go untreated.”

A concussion, also referred to as a mild traumatic brain injury (mTBI), is the most common type of traumatic brain injury. Although concussions may not be immediately life-threatening, the effects can be serious, cause significant interruptions in one’s life, and require lengthy treatment. An mTBI occurs when a blow to the head causes the brain to move back and forth rapidly. As the skull bone is hard and the brain material is soft, the brain bounces back and forth on the walls of the skull. The resultant “brain bruise” impairs proper functioning of the brain; thus, the ability to focus, think, recall, and formulate ideas becomes impaired.

The symptoms of TBI are variable and include headaches, neck pain, nausea, ringing in the ears, dizziness, blurred vision, fatigue, and excessive tiredness. These symptoms may not present initially at injury but evolve over time. Accident victims often feel dazed and “not themselves” for days to weeks after the injury. If the TBI is complex with a brain bleed, this can lead to serious medical emergencies such as confusion, slurred speech, weakness, numbness, loss of coordination, convulsions or seizures.  These need immediate evaluation by medical professionals. Most symptoms typically resolve within 6-8 months.

TBIs are diagnosed by a medical professional through an initial physical exam, including a neurological exam, which checks vision, balance, coordination, and reflexes. Memory and cognition are evaluated, and often re-evaluated to monitor progression. Depending on the forces involved and the presenting physical examination, a CT scan may be obtained at the time of injury to assess for life threatening emergencies such as bleeding within the brain. A normal CT scan does not rule out a TBI. Follow-up studies with 3T MRI can demonstrate subtle irregularities that confirm the presence of brain injury months later.

Most people fully recover from a single TBI event. Brain rest is especially important for healing.  Limiting activity, especially tasks involving focus and concentration, such as studying, working on the computer, or even playing video games help reduce concussion symptoms of headaches and brain fatigue. When symptoms persist, a medical professional may recommend further testing and evaluation by neurocognitive specialists. Recovery from a TBI is a dynamic process that takes time and patience. Injured victims can suffer from ongoing headaches, emotional dysregulation, impairment in their ability to work, and strained interpersonal relationships.

The responsible party only had $100,000 in coverage. My client, a 78-year-old married man, sustained a fractured nose, fractured patella, and horrible overall bruising as he was on anti-coagulation therapy. He also suffered enlargement of an abdominal aortic aneurysm. Medical bills were about $60,000 as covered by Medicare. Because my client had uninsured/underinsured motorist (UM/UIM) coverage, I secured a very nice settlement for him. Otherwise, he probably would have only received a very small net recovery, my fees, and reimbursement of Medicare. I have been told as high as 70% of Californians are uninsured or have State minimum coverage of $15,000/$30,000 for personal injury claims. Thus, if seriously injured in a motor vehicle collision, you have a 70% chance of not being properly compensated for your injuries. Indeed, most of the cases I handle have injuries valued well in excess of even extremely large automobile personal injury liability coverage. The solution for this danger is to purchase UM/UIM coverage. Most people require the ability to work to manage a household. Even minor automobile collisions can preclude employment for a significant amount of time, interrupting vital income. Next, medical treatment costs and out-of-pocket expense can be extraordinary, too. You can protect against these risks by purchasing UM/UIM coverage. In general, UM/UIM coverage is insurance protection you purchase for the possibility you will be injured by someone with little or no automobile liability coverage. Like all insurance, the cost is based on many variables including your age and amount of coverage desired. UM/UIM coverage issues vary in complexity and are factually dependent. Should you have such a possible claim, you should obtain legal counsel to advise you. Generally, UM/UIM provides a means of recovery for injuries inflicted by people with insufficient insurance. I universally recommend my clients purchase the maximum UM/UIM available. The specifics should be discussed and part of a comprehensive financial plan. In a horrific collision, UM/UIM may be the greatest asset you have. UIM coverage “kicks in” in excess of insurance carried by the responsible party. Thus, if the responsible driver has $100,000 in coverage and UIM is $500,000, the Insured (you, the reader who owns the UIM) is entitled to up to $400,000 in coverage from their automobile insurer. You may also have heard of Third-Party Claims. Unlike claims against a responsible party, in Third-Party claims (where the injured party is a “third party” to the contract of insurance between responsible driver and his/her insurer), a UIM insurer owes its Insured a Duty of Good Faith and Fair Dealing. Therefore, if not treated fairly, the Insured could also sue for “Bad Faith” and recover additional funds. Because of this dynamic, insurers are much more realistic in valuing and settling UIM claims than Third Party Claims. Personal injury claims are valued in part by lost wage and medical care costs. Given the sky-high cost of medical care, even a case involving a simple fracture healed with surgery in six weeks, along with a couple months of rehabilitation, can easily result in a claim worth more than $500,000. More serious or extensive injuries of course lead to more valuable claims. How can we protect ourselves against such claims when auto policies and homeowners’ coverage is usually insufficient? Umbrella policies or formally Personal Liability Umbrella Policies (PLUPs) provide excess coverage above policy limits on motor vehicles and for claims covered by homeowner’s policies. Crime victims are entitled to recover restitution. Unlike civil cases which allow victims to recover both general and special damages, crime victims are limited to recovery of Restitution or economic loss, also known as special damages. While this recovery is more narrow, the impact on a civil case cannot be understated.

When a criminal defendant is convicted by either Trial or guilty plea, the court must impose a sentence. Where the victim suffers economic loss, the Court must also impose Restitution. In a civil case, the conviction conclusively establishes the defendant’s responsibility for the criminal act. Likewise, the Restitution conclusively establishes the defendant’s responsibility for the victim’s economic loss. This is a tremendous benefit to a crime victim that also seeks civil remedy. Civil defendants, funded by insurance companies, have access to experts of easy virtue that will routinely testify victims could not have been injured in such incident, were not injured and/or they are all better or exaggerating their symptoms. Such testimony drives up the cost of civil litigation reducing a civil litigant’s ultimate recovery.

In a recent case, the right to compensation by a restitution order was expanded to include infractions of the law. In the case of <em>People v. Smalling</em>, a shop owner was convicted of an infraction, allowing dogs on his premises to kill a guide dog. The victim sought restitution in the trial court but was denied. On appeal, the Los Angeles Superior Court Appellate Division directed the Trial Court to hold a hearing on the value of the service dog and impose those costs as restitution upon the defendant.

Civil attorneys miss out on a golden opportunity when they fail to pursue full Restitution for their clients in the criminal courts. The law authorizes the civil attorney to appear and put on evidence of their clients’ economic loss in the criminal courts. In addition, they are entitled to recovery of attorney’s fees for such efforts.
